Participants agree to release, discharge and save harmless (i) MasterCard International Incorporated and its officers, directors, employees, consultants, parent companies, subsidiaries, affiliates, and advertising/promotion agencies, (ii) the owners of Center and (iii) The Taubman Company LLC, their officers, directors, employees, subsidiaries and affiliates (“Promotion Parties”) from and against any and all injuries, liability, losses and damages of any kind resulting from Participant’s participation in this Promotion and/or Participant’s acceptance, use, misuse or possession of any gift, or lost or misdirected gifts; for lost, illegible, incomplete, inaccurate, late, misdirected, mutilated, or stolen entries; failure to process entries; failures or malfunctions of computer systems; interrupted or unavailable network, server or other connections, miscommunications, failed computer hardware or software or other technical failures; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; printing errors appearing within these Terms or in any promotion-related advertisements or other materials; failures of electronic equipment, computer hardware or software; or inaccurate entry information.
