Bei Überschreitung des vereinbarten Liefertermins um mehr als einen (1) Arbeitstag hat der Lieferant XXXX auf Verlangen eine Vertragsstrafe in Höhe von 0,15 % des Wertes des Abrufauftrages für jeden Arbeitstag der Überschreitung, höchstens jedoch 5 % des Wertes des Abrufauftrages zu zahlen. Dies gilt auch dann, wenn XXXX sich die Vertragsstrafe bei Annahme nicht ausdrücklich vorbehält. Die Vertragsstrafe wird auf einen etwaigen Schadensersatzanspruch von XXXX wegen Lieferverzuges angerechnet.

es gibt da einige Möglichkeiten, das auszudrücken. In jedem Fall ist es ein Abzug von etwas. imposed trifft hier nicht zu

Discussion
Dann macht er vielleicht einen Mangelfolgeschaden geltend und bekommt nach 12 oder mehr Monaten das Urteil. Der Lieferant kann dann vom gerichtlich festgelegten Schadensersatz die bisher gutgeschriebene Vertragsstrafe abziehen.
So würde ich das sehen.
