In reality, auctions are a relatively common way to buy and sell a huge variety of assets ranging from art work to real property, from rights to air waves to household furniture. They are a common method used to raise money for foundations and churches and a typical way for the average probate estate to sell its real property or a trustee in bankruptcy to liquidate a business.

Acceptance of a bid is denoted by the fall of a hammer, or by any other audible or visible means signifying to a bidder that the bidder is entitled to property on paying the amount of a bid according to the terms of a sale.

...accepting a bid on the parcel, the successful bidder or purchaser of the property may not unilaterally rescind the bid. The County legislative body, after acceptance of a bid, may enforce the terms of the bid by obtaining a legal judgment against the purchaser in the amount of the bid plus interest and attorney's fees.
