français term

"dénonciation"

français vers anglais Droit / Brevets Droit (général) Writ
Hello

This is part of a document title "Dénonciation de l'assignation en référé en date du 16 décembre ..." in which the party having received the writ dated 16 December responds arguing that it is not liable.

Would the correct term here be repudiation? The target audience is UK.

TIA for your help

Nikki Scott-Despaigne Mar 19, 2015:
Is there any reference made, for example, to a particular article of the NCPC?
Nikki Scott-Despaigne Mar 19, 2015:
Andrew Would it be possible to have a littel more context other than the denial of liability by the party upon whom the writ has been served?
liz askew Mar 17, 2015:
non-compliance?

notice

I think that here "dénonciation" refers to formal notice of the writ given to the party (this is usually a third party, although from what you say, it seems this is not the case here) and does not have anything to do with refuting it. When "dénonciation" is used in relation to process (the writ in this case) rather than substance (the actual arguments) it generally has the meaning of "notice" in French.
For an example, please see http://www.textes.justice.gouv.fr/art_pix/104-DACS-a.pdf (p. 8). The relevant decree, which you can find on the Légifrance site (see reference below) is "Décret n° 2006-936 du 27 juillet 2006 relatif aux procédures de saisie immobilière et de distribution du prix d'un immeuble" (see Articles 40-42) Of course, this is about attachment of property, but the principle remains the same in other cases.
For an example in English see http://www.irs.gov/pub/irs-tege/epche12c03.pdf (p. 12)

agree Nikki Scott-Despaigne : http://www.legifrance.gouv.fr/affichJuriJudi.do?oldAction=re... (This extract may help). There are a couple of possible readings, but with this suggestion seems to be the most likely.

refutation

"Repudiation" is not right, because that is about rejection of something previously acknowledged or owned.

application to set aside

Now find term other than expedited application e.g. motion (in chambers or otherwise) for assignation en référé.

Your "clue" about the respondent arguing it is not liable is probably misleading us..
