Let me give you a concrete and absolutely current example to illustrate the quintessential difference between 'modern' and 'state of the art':
I'm participating in this disussion through a 'modern' telecoms system known, in general terms, as 'broadband mobile'. Wow! - That's really 'state of the art', isn't it!
Errrr.... No, it is not. Far from it!
My data-rate through this supposedly 'state-of-the-art technology' only very rarely exceeds 8 kbit/s (that's with a following wind). In contrast, my connection in Belgium - 15 years ago - actually delivered 56 kbit/s. Now, that WAS 'state-of-the-art' (at that time).

En français, l'état de l'art est l'ensemble des techniques couramment employées dans un secteur technique. Cela peut correspondre aux techniques les plus modernes mais ce n'est pas synonyme de technique de pointe qui fait référence à une exception.
Even if we accept that state-of-the-art 'usually' implies a measure of 'modernity', as per your 'definition', it is by no means essential.
I consider myself 'modern' (as homo sapiens go) - but I am by no means 'state-of the art'. Heaven forbid! :)
