Danish term

opretholdelsen af en tilstand

Danish to English Law/Patents Business/Commerce (general) Employment contract - non-competition clause
Hi, I'm having difficulty coming up with the correct translation for this and making it fit with the rest of the sentence - I've come up with "If the violation consists of an ongoing circumstance that is in breach of non-competition clause, a violation exists as of the commenced calendar month in which the violation occurs."

Thanks for your help!

Består overtrædelsen af opretholdelsen af en tilstand, der er i strid med konkurrenceklausulen, foreligger der en overtrædelse pr. påbegyndt kalendermåned, hvori overtrædelse finder sted.

(AmE) an ongoing > (BrE) a continuing > state of affairs (breach)

I believe the stnadrad EN law phraseology would also be usable in most, if not all, US federal state courts.
Example sentence:

Private nuisance was defined in Bamford v Turnley,[18] where George Wilshere, 1st Baron Bramwell defined it as "any continuous activity or state of affairs causing a substantial and unreasonable interference with a [claimant's] land or his use or enjoymen

maintaining a situation

"maintaining a situation" or "maintaining a condition", but "condition" can also mean something else, so "situation" is less ambiguous.

I don't agree with "on-going", as it implies a longer duration.

It doesn't look very 'Danish' to me in the first place, so it may well have been translated from English originally. "Opretholdelsen" doesn't sound natural to me, and it could be a direct translation of "maintaining".

maintaining a position

'If the violation consists of maintaining a position....'

A position can be a market position, a legal position, or strategic position.
At this point, we are talking about an overlap between copywriting and translations.
Just get creative.
