OATH is independent from the agencies that issue the summons and as the nation's largest administrative tribunal; it takes its independence seriously. OATH has a Trials Division, which handles complex administrative law matters and a Hearings Division, which handles hearings on summonses.

If a penalty is noted on your summons and the summons does not state that you must appear, you may wish to pay the penalty and not appear at the hearing. If you pay your summons on or before the hearing date without having a hearing, you are admitting to the charge and you waive your right to a hearing.

Jesli chodzi o "criminal summons" to skoro w tym wypadku to jest wykroczenie, to wtedy mamy dokładnie:
"wezwanie w chrakterze podejrzanego o popełnienie wykroczenia"
albo
"wezwanie w charakterze podejrzanego w sprawie o wykroczenie z art. X"
"wezwanie w chrakterze podejrzanego o popełnienie wykroczenia"
albo
"wezwanie w charakterze podejrzanego w sprawie o wykroczenie z art. X"

civil summons - wezwanie w sprawie o czyn zabroniony (=wykroczenie) zagrożony sankcją cywilną.
Trochę to przekombinowane, ale przynajmniej oddaje w miarę wiernie ideę.
- mandat wraz z wezwaniem (w sprawie rozpatrywanej) w postępowaniu o wykroczenie/wykroczeniowym vs. w postępowaniu karnym
- mandat wraz z wezwaniem w sprawie o wykroczenie vs. w sprawie karnej
Można też pójść dalej i odpuścić sobie wyraz mandat i zostać tylko przy wyrazie wezwanie, ale wtedy trochę odejdziemy od tego czym w praktyce ten dokument może być na co dzień w NYC. Kto wie, nie mieszkałem tam, więc do końca nie wiem.

Oczywiście, kwalifikacja prawna danego czynu w lokalnym prawie może być inna niż w PL. Mamy wyraz "civil", co trochę komplikuje sprawę i może mylnie sugerować czyn, który w PL pewnie podlega kodeksowi wykroczeń. Ale cóż, co kraj, a właściwie co stan, to obyczaj.
W poniższym artykule w odniesieniu do "civil summons" mowa o minor offences, i słusznie, bo do tego się ten dokument odnosi.
