requiring initiation by a private citizen or entity Explanation: Or "subject to a filing by a private citizen", or something along those lines, but definitely not "a particular authority". For "instancia", compare this usage: "a instancia de, o a instancias de 1. locs. prepos. A ruegos de, o a petición de." https://dle.rae.es/instancia "Particular" here means a private citizen or entity. So I believe it refers to some kind of "private prosecution," where the state brings a prosecution only after a citizen/entity files a criminal complaint. For more information, see the following Wikipedia entry: "A private prosecution is a criminal proceeding initiated by an individual private citizen or private organisation (such as a prosecution association) instead of by a public prosecutor who represents the state. of a type triggered on a private complaint Explanation: - rather than on the initiative of a private cititen. It is for the prosecuting authority to decide what happens at the next stage. Also: delitos de acción pública are 'publicly prosecutable criminal offenc/ses' at the discretion of or automatically by the prosecuting authority rather than ones 'requiring' pub. pros. BTW, this is not about a private prosecution that can be 'nolle prosequied' - stopped by the public prosecutor, Justice Minister or District Attorney / Attorney-General etc. from proceeding. Reference: Refs. Reference information: Crimes requiring public action (prosecution?) which depend on a xxx / (particular authority?). an investigation will be carried out (conducted) where there it is a flagrant crime (delito flagrante - you have: "when they are discovered while in progress"????) or there is a complaint from the person entitled to bring the action. Robert has entered an answer "requiring initiation by a private citizen or authority" and quoted the "RAE". However, I am not 100% certain myself and therefore, not prepared to counter his answer, but based on another dictionary (below), No. 2 and No 6 (below) are given- https://www.wordmagicsoft.com/dictionary/es-en/instancia.php 1. instance, case in point, occurrence 2. ***request***, petition, entreaty 3. instance, case 4. agency 5. institution 6. ***authority*** 7. process of a suit, proceeding 8. level of jurisdiction, instance While not a part of the original question, and the reason for my posting this reference: https://www.wordmagicsoft.com/dictionary/es-en/delito flagra... Plural: delitos flagrantes Translate "delito flagrante" to English: flagrante delicto, crime detected by authority, flagrant crime Spanish Synonyms of "delito flagrante": crimen detectado por la autoridad, flagrante delito flagrant adjective (of an action considered wrong or immoral) conspicuously or obviously offensive. |
