For simplicity, our proposal uses the same concept of “broad-based” as applies for the current ESS tax concessions. This is a minimum participation requirement. In our experience, employers would typically offer participation in the ESS to an even *broader group of employees*, recognising that maximum alignment of interests requires a larger proportion of employees to be offered participation. We would support further consideration of extending the minimum participation requirement to cover more employees.
