32.Right to Refuse

Buyer reserves the right to refuse or cancel an order if the price invoiced is higher than that quoted in the order. If the Seller provides the Buyer with due notification of a price increase applying against an outstanding order the Buyer shall have the option of accepting the price or canceling the order.

Sytuacja opisana jest bardzo dziwna. Cena w ofercie handlowej i dalej w zamówieniu jest 'jakaś', a następnie na fakturze pojawia się wyższa cena. Gdybym miał taką sytuację w pracy, pierwsze co bym zrobił, to nie przyjął takiej faktury i zażądał zmiany ceny na tą z oferty/zamówienia. A jeśli dostawca by tego nie zrobił, odesłałbym towar lub jeśli to jest wykonana już usługa, to zapłaciłbym zgodnie z ofertą/zamówieniem. U mnie w biurze nawet system komputerowy nie pozwala na takie zmiany ceny. Zastosowanie innej ceny wymaga renegocjacji i złożenia nowej oferty, a następnie nowego zamówienia.
