No, właśnie. Frank cytuje definicję "common law marriage" dotyczącą US, chociaż z pytania wiadomo, że tłumaczenie będzie czytane w CA. Nie wiem, czy w prawie CA obowiązuje takie samo znaczenie jak w US.

Proszę zauważyć uzupełnienie kontekstu: "takie zdanie: Pozostajemy w nieformalnym związku konkubinatu od...". Jeżeli tak, to moim zdaniem najlepszym rozwiązaniem byłoby dosłowne tłumaczenie: "We have been in an informal cohabitating relation since...". Czytelnik będzie wiedział, że sytuacja dotyczy PL (nie US, nie CA), więc w ten sposób tłumacz uniknie używania określeń/sformułowań, które mogą wprowadzić w błąd.

Moją sugestię z wcześniejszego wpisu modyfikuję do: informal cohabitating partners/relation.

Ponadto możliwe, że przydałby się krótki opis różnicy między PL "konkubinat" a CA "informal cohabitating partners/relation", ale to kwestia dla polskiego prawnika w CA.

Mały off-topic. Pozwolę sobie zacytować kolegów:

"A - Tłumaczenie powinno przekazywać sytuację prawną w Polsce.
F - Tak ale tłumaczenia jest przeznaczone na kraje anglojęzyczne."

Ten problem jest omawiany przy różnych okazjach, na przykład, na spotkaniach tłumaczy, czy spotkaniach tłumaczy z prawnikami.

Sprawa lokalizacji jest chyba wszystkim znana. Idąc dalej, kwestia lokalizacji w tekstach prawniczych czy prawnych jest już bardziej skomplikowana i wymaga szerszej wiedzy prawniczej. Do tego dochodzą pewne luki prawne, chociażby brak regulacji o konkubinatach czy związkach partnerskich w Polsce, wskutek czego, na przykład, konkubenci po śmierci partnera nie mają prawa do "należącej" do niej/niego części majątku, itd.

Lokalizacja tekstu prawnego czy prawniczego jest z jednej strony pożądana, a z drugiej, w pewien sposób ryzykowna, bo być może transkreacyjna. Krótko mówiąc, sprawa jest głębsza i sięga do samego d n a :)
