Portuguese term

vínculo de filiação

Portuguese to English Law/Patents Law (general) court ruling granting socio-affective parenthood to relatives

"Filiation in the civil law is, from the child's perspective, the legal bond connecting child and mother or child and father. In the common law, the legal bond is known as parentage. Crucially, parental status—filiation in the civil law or parentage in the common law—is a legal construct and must be established." (McGill Law Journal)

Bond of filiation? Filial bond? Parentage?

Discussion

Oliver Simões (asker) Mar 1:
Thank you all I have to deliver the translation ASAP, which means I had to make a decision on how to translate.

I decided to stick to bond of filiation along with a footnote explaining the common law equivalent ("parentage").

filiation:
- the fact of being or of being designated the child of a particular parent or parents. (Oxford Lang. Dictionary and Google)
- a legal relationship of a parent and especially a father and child that creates rights and obligations. (Merriam-Webster)

kinship bond

No through explanation as readers ought to know that *affiliation* > see the first weblink > proceedings in English law are now called a 'paternity suit' - aligning and dovetailing with US-Am., Canadian, Aussie + Kiwi etc. terminology.

A filiação socioafetiva : 'socio-affective' -> emotionally close kinship.

Filiation : translatorese and too phonetically close to FILLETS of steak.

Example sentence:

Many codes of ethics consider the bond of kinship as creating obligations between the related persons stronger than those between strangers, as in Confucian filial piety.

Note from asker:
“Filiation” phonetically close to “fillet”? Not even by a close shave. And it’s not “translatorese”. Look it up in Merriam-Webster and you’ll be surprised. I don’t foresee replacing “filiação” with “kinship”. The latter denotes “blood relationship”, which most definitely does not apply to one of the applicants, who is married to the minor’s aunt. Thanks for trying.
