Votes to reclassify question as PRO/non-PRO:

Non-PRO (2): mchd, Yvonne Gallagher

When entering new questions, KudoZ askers are given an opportunity* to classify the difficulty of their questions as 'easy' or 'pro'. If you feel a question marked 'easy' should actually be marked 'pro', and if you have earned more than 20 KudoZ points, you can click the "Vote PRO" button to recommend that change.

How to tell the difference between "easy" and "pro" questions:

An easy question is one that any bilingual person would be able to answer correctly. (Or in the case of monolingual questions, an easy question is one that any native speaker of the language would be able to answer correctly.)

A pro question is anything else... in other words, any question that requires knowledge or skills that are specialized (even slightly).

Another way to think of the difficulty levels is this: an easy question is one that deals with everyday conversation. A pro question is anything else.

When deciding between easy and pro, err on the side of pro. Most questions will be pro.

* Note: non-member askers are not given the option of entering 'pro' questions; the only way for their questions to be classified as 'pro' is for a ProZ.com member or members to re-classify it.

description de la propriété / du bien immobilier [à valeur légale]

sous-entendu: description à valeur légale / probante / description contraignante: si la propriété est décrite comme ayant une superficie de 100m2, la superficie réelle doit obligatoirement être 100m2, non pas 99m2 ou encore moins;

what you will find in these adverts is NOT a legally binding description of these properties

en d'autres termes, ils se lavent les mains de toute responsabilité si la description d'une propriété s'avère être 'légèrement' fantaisiste!
Peer comment(s):

agree Tony M : Probably not 'propriété' though, which connotes a very specific TYPE of 'bien'; 'bien (immobilier)' is fine

disagree Daryo : too much off mark - 'property particulars' is far more than just the exact location of the property.

une description immobilière

'property particulars' means actual factual details about a property; they are by nature an offer which is legally binding, and so must be accurate in all respects; hence why this document is at pains to explain that what we have here is just an informal description of the properties, i.e. cannot be legally binding.

As there is a potential conflict between the translations of 'description' and 'particulars', I don't know whether it would perhaps be possible to use 'renseignements' here in FR instead? But I have a feeling that what FR estate agents issue is indeed a 'description'. Or maybe perhaps even 'détails'??

Didier has made a very important point in his ref. comment, and I think one can keep the intention of the original, even against a different legal background, if one uses something like (and I quote directly from Didier's comment):

'la fiche descriptive de l'annonce immobilière ne constitue pas une offre de vente'

La fiche descriptive n'est pas une offre de vente

On tombe là sur une différence entre le droit "common law" sans doute applicable au texte source et le droit civil ou romano-germanique français, il se pourrait que l'adaptation du texte conduise à cette interprétation que la fiche descriptive de l'annonce immobilière n'est pas une offre de vente, qui elle est un engagement juridique, mais on s'éloigne du texte source
