Last will and testament
Hi there :)
I'm doing some QA tasks on a will that was translated from English into French and I'm extremely confused by the wording of the following bit: "PROVIDED ALWAYS that this gift shall bear its own share of inheritance tax [...] payable on or by reason of my death to hold the same UPON TRUST for such of my said two children".
The French translation provided by the translator does not sound quite right to me: "À CONDITION QUE lesdites cessions supportent une partie des droits de succession [...] payable dans l'éventualité de mon décès et assujjetti AUX FIDUCIES de mes deux enfants".
Could anyone please shed a light on this? Very much appreciated!

It would be helpful to have even more context, if possible. I presume the verb 'hold' refers back to a person (the trustee) mentioned before the start of the quoted extract.
And it is not altogether clear what the singular 'this gift' refers to (legacies?).
Also, it would be helpful to know what follows the extract, as 'such of my said two children' would normally be followed by a qualifying phrase (e.g. 'such of my children as shall survive me').
In my suggested translation I would replace the ellipsis with the name/designation of the trustee.
You are right to query the original translation. Subject to my comments above, I would be inclined to propose something along the following lines: 'étant entendu que [ce legs?] supportera sa propre part des droits de succession à payer à l'occasion ou en raison de mon décès, à charge pour [...] de le détenir en fiducie ('trust') au bénéfice de l'un et/ou l'autre de mes deux enfants susnommés ...'.
Hope this helps.
