I was tempted to say, "beyond the scope", as well, but chose "outside the scope" instead so as to translate 'εκτός' more literally. Both "beyond the scope" and "outside the scope" appear to be used with almost equal frequency in British English.

"Exceed" or "exceeded" may be possible here - I would not use the noun "excess" - but I agree that it would be better to say it in a different way. "Beyond the ... scope" seems a good option.

Say it in a different way I would say this in a different way, such as, "Acts of the administrator, even if they are outside the company scope, bind the company against third parties, except if the company proves that the third party knew (or, was aware) that the company scope had been exceeded or should have known it."
