It's not an appeal The answer linked to by Taña is not correct. In this context, and in some jurisdictions (VE, CL, maybe others) a 'consultación' is not an 'appeal'. In divorce proceedings, the 'sentencia' handed down in the court of first instance always has* to be submitted to a higher court for ratification or reversal, mainly for the purpose of verifying that there are no untoward 'public order' implications. Neither party has to 'appeal' for this purpose - it's part of the standard procedure, handled internally by the judiciary. (Of course, either party may also, and simultaneously, appeal against the 'sentencia' if they think they've been wronged.)
* The 'consultación' of divorces and annulments was abolished in Chile a few years ago, when divorce was legalised.
