Crimes especificos próprios e impróprios

Portuguese to English Other Law (general) English UK
I need help translating the above. Can anyone help? Thank you in advance!

Crimes específicos próprios – são aqueles crimes que não têm correspondência com outros crimes – e, por isso, só podem ser praticados por pessoas com determinadas qualidades.

Crimes específicos impróprios - são aqueles que têm correspondência com outro crime que pode ser praticado por qualquer pessoa. Assim, o crime específico impróprio é uma variante de um crime fundamental que pode ser praticado por qualquer pessoa; mas o facto de ter sido praticado por aquela pessoa agrava a responsabilidade.

Discussion

Mario Freitas Mar 15, 2023:
@ All The concept in Brazilian law is quite different than what Andrew mentioned below.
The "crime próprio" is committed by the person at their own will, for their own interest and benefit. The "crime impróprio" is a crime committed by someone else, but the person is involved for being a parent, a guarantor, a co-signer or something like that.
In the Brazilian law, the term "próprio" is not a synonym of "propper" in English. It is a synonym of "one's own". Therefore, subjective or objective, as suggested by Adrian.
I believe it would be the same in Portugal.

@Ana You're welcome !
Ana Costa (asker) Mar 15, 2023:
@Andrew - Thank you, Andrew. I have been doing some more research and found direct and indirect specific crimes. I believe that could be it.
Andrew Bramhall Mar 15, 2023:
Specific crimes proper - are those crimes that have no correspondence with other crimes - and, therefore, can only be committed by persons with certain qualities.

Improper specific crimes - are those which have a correspondence with another crime that can be committed by any person. Thus, the improper specific crime is a variant of a fundamental crime that can be committed by anyone; but the fact that it was committed by that person aggravates responsibility.

Portuguese term (edited): crime/s especifico/s próprio/s e impróprio/s

subjectively offender-specific and objectively non-specific crime/s sui generis

Methinks is nowt to do with crimes or criminal offenc/ses of general or specific intent in English law, rather to do with the status (qualidade) of the offender or naughty miscreant.

> sui generis : in category of its own.
Example sentence:

Exemplo: se houver violação de domicílio, praticada por qualquer pessoa, vamos buscar o art.º 190º (impróprio). Mas se esse crime for praticado por um funcionário, aí aplica-se o art.º 378º (próprio)

Terrorism: a type of organised crime or an offence sui generis?

Specific, proper and improper crimes

In the current modern texts of law codes, in particular, in the criminal law one, the legal system identifies special characteristics in every single criminal case by examining each crime, having as its foundation a “structure of the crime.” Consequently, the criminal system applies this structure to every single point of crime by identifying its essential elements, the objective element (event, causal link, and modality), and the subjective elements (causes of justification, conduct, subjective and legal capacity/ability), which are essential their existence and presence for the commission of a criminal offense. In addition, the doctrine to the Criminal Law pays attention, with reference to the subjective element author natural person, defines the “proper crime” from the “improper crime”; the author of the criminal act is distinguished by virtue of particular duties or qualities of work, it is also distinguished when an individual, by means of an active action (a doing, where the recipients are any person) or omissive action (a not doing, the recipients are particular/specific persons in charge of social responsibility or by means of legal contract) is. Therefore, it was necessary to list the above premises in order to understand the meaning of the phrase “white-collar crime.” — In “ The Historical And Legal Evolution Of White-Collar Crime” https://i-aml.com/news/the-historical-and-legal-evolution-of...

This magazine article in Portuguese gives specific examples of “crime próprio” versus “crime impróprio”. Use these specific keywords to find them. https://revista.uninga.br/uninga/article/download/3138/2028/...

Example Sentences

From my interpretation, the term ‘proper crime’ means crimes that are more serious which require a more severe means of punishments, unlike minor offences where the form of punishment is often dealt with via a fine, like strict liability. https://www.lawteacher.net/free-law-essays/criminal-law/an-a...

There was research about attempted and consummate homicide, which is an improper crime according to both Criminal Code and the Military Criminal Code, whose competence to investigate belongs to the Judiciary Police. https://www.fpl.edu.br/2018/media/pdfs/mestrado/dissertacoes...

agree Andrew Bramhall : Sounds good to me! sticks to and follows the ST, without wandering off into the sphere of personal inventions.
