EL PLENO DE LA CORTE CONSTITUCIONAL DEL ECUADOR,
EN EJERCICIO DE SUS ATRIBUCIONES CONSTITUCIONALES Y LEGALES, EMITE LA SIGUIENTE
Sentencia
Tema: En la presente sentencia la Corte analiza si el juez de garantías jurisdiccionales era el competente para resolver una acción de protección. Se resuelve desestimar la acción estableciendo que la autoridad judicial fue la competente.
I. Antecedentes Procesales
El xx de abril de 2013, Douglas xxxx xxxx , Freddy xxxxx xxxxx, Alex xxxx xxxx Barzola, Franklin xxxxx xxxxxx, Christian xxx xxxxxx, Gregorio xxxx xxxxxx Méndez, Eloy xxxxx xxxxx, Diego xxxxx xxxx y Pablo xxxx xxxx (“los accionantes” o “los profesores de la Universidad de Guayaquil”) formularon acción de protección contra la Universidad de Guayaquil aduciendo que la negativa de renovación de sus contratos, como docentes, vulneró sus derechos constitucionales al trabajo y a la estabilidad docente, contemplados en los artículos 33 y 349 de la Constitución de la República del Ecuador.
El 29 de mayo de 2013, la Unidad Judicial N°. 1 de Contravenciones de Guayaquil, resolvió desechar la acción de protección, señalando que se debe recurrir a la vía ordinaria para solventar la pretensión de los accionantes. Frente a esta decisión, los profesores de la Universidad de Guayaquil dedujeron recurso de apelación.
El 09 de agosto de 2013, la Segunda Sala de lo Penal, Colusorio y Tránsito de la Corte Provincial del Guayas, resolvió aceptar el recurso de apelación y aceptó la acción de protección, estableciendo que “(…) a los accionantes se los reintegre a las funciones que venían desempeñando como profesores de la Facultad de Ciencias Médicas, con la misma carga horaria y remuneración del personal docente de planta (…)”.
El 30 de agosto de 2013, Carlos Cedeño Navarrete, en calidad de Rector de la Universidad de Guayaquil, presentó acción extraordinaria de protección contra la sentencia expedida por la Segunda Sala de lo Penal, Colusorio y Tránsito de la Corte Provincial del Guayas emitida el 09 de agosto de 2013.
El 08 de octubre de 2013, la Secretaría General de la Corte Constitucional del Ecuador, certificó que no se presentó otra demanda con identidad de objeto y acción.
El 06 de febrero de 2014, la Sala de Admisión conformada por los jueces constitucionales María del Carmen Maldonado, Ruth Seni Pinargote y Antonio Gagliardo, admitió la demanda de acción extraordinaria de protección.
El 23 de julio de 2018, la Jueza Constitucional Ruth Seni, mediante providencia, avocó conocimiento de la causa, dispuso la notificación a las partes procesales y solicitó informes a la Corte Provincial de Justicia del Guayas.
El 05 de febrero de 2019 fueron posesionados ante el Pleno de la Asamblea Nacional los jueces y juezas constitucionales xxxxx xxxxxx xxxx xxxxx .
En virtud del sorteo realizado por el Pleno de la Corte Constitucional, en sesión ordinaria de 19 de marzo de 2019, correspondió el conocimiento del presente caso a la jueza constitucional Karla Andrade Quevedo; quien avocó conocimiento de la causa, solicitó informes a las autoridades judiciales y dispuso correr traslado a las partes, en auto de 18 de septiembre de 2019.
Previo a resolver el caso concreto, esta Corte Constitucional deja constancia del incumplimiento de los anteriores miembros de la Corte Constitucional, quienes no emitieron el pronunciamiento que en su debido momento correspondía realizar.

THE PLENARY OF THE CONSTITUTIONAL COURT OF ECUADOR, IN EXERCISE OF ITS CONSTITUTIONAL AND LEGAL ATTRIBUTIONS, ISSUES THE FOLLOWING
Sentence
Subject: In this judgment, the Court analyzes whether the judge of jurisdictional guarantees were competent to decide a protection action. It is resolved to dismiss the action establishing that the judicial authority was the competent.
I. Procedural Background
On April xx , 2013, Douglas xxxx xxxxxx , Freddy xxxx xxxxx, Alex xxxx xxxx, Franklin xxx xxxxx, Christian xxxx xxxxxx, Gregorio xxxx xxxxxx, Eloy xxxxxx xxxxx, Diego xxxx xxxxxand Pablo xxxx xxxxxx (“the plaintiffs "or" the professors of the University of Guayaquil”) formulated protective action against the University of Guayaquil arguing that the refusal of renewal of their contracts, as teachers, violated their constitutional rights to work and to stability teachers, referred to in Articles 33 and 349 of the Constitution of the Republic of the Ecuador.
On May 29, 2013, the Judicial Unit No. 1 Infringements of Guayaquil, decided to discard the protective action, noting that it should appeal to the ordinary way to settle the claim of the plaintiffs. Faced with this decision, the professors of the University of Guayaquil deducted an appeal.
On August 9, 2013, the Second Criminal, Collusive and Transit Chamber of the Guayas Provincial Court, decided to accept the appeal and accepted the protective action, establishing that “(…) that the plaintiffs be reinstated to the functions they had been performing as professors of the Faculty of Medical Sciences, with the same workload and remuneration of the permanent teaching staff (…)”.
On August 30, 2013, Carlos Cedeño Navarrete, as Rector of the University of Guayaquil, presented an extraordinary protection action against the sentence issued by the Second Criminal, Collusive and Transit Chamber of the Guayas Provincial Court issued on 09 August 2013.
On October 8, 2013, the General Secretariat of the Constitutional Court of Ecuador certified that another lawsuit was not filed with identity of object and action.
On February 6, 2014, the Admission Chamber made up of constitutional judges María del Carmen Maldonado, Ruth Seni Pinargote and Antonio Gagliardo, admitted the demand for extraordinary protective action.
On July 23, 2018, Constitutional Judge Ruth Seni, by means of an order, took cognizance of the case, ordered the notification to the procedural parties and requested reports from the Provincial Court of Justice of Guayas.
On February 5, 2019, the constitutional judges were inaugurated before the Plenary of the National Assembly: xxxx xxxxx xxxx xxxxx xxxxx xxxx.
By virtue of the draw carried out by the Plenary of the Constitutional Court, in ordinary session of March 19, 2019, the knowledge of the present case corresponded to the constitutional judge Karla Andrade Quevedo; She who advocated knowledge of the case, requested reports from the judicial authorities and ordered that the parties be transferred, in an order of September 18, 2019.
Prior to solving the case, the Constitutional Court states the failure of the former members of the Constitutional Court, who did not issue the statement in due course, should be made.
