The obligations under the Loan constitute direct, unconditional, unsubordinated and unsecured obligations of the Borrower and rank pari passu with all other unsecured Borrowing Obligations (as hereinafter defined) of the Borrower and all its unsecured obligations under guarantees for Borrowing Obligations of third parties, except for accorded preference by mandatory provisions of law.
