La palabra “pretensión” utilizada en diversas definiciones de esta regla de derecho, es entendida actualmente en un sentido más amplio que el que se adjudica a la palabra en materia procesal –ámbito en el que algunas tesis previas limitaban la aplicación de la regla.
Ahora el concepto de pretensión, en la teoría del acto propio, sigue rigiendo en el ámbito judicial, pero también en el extrajudicial, en el contractual como en el extracontractual. “Pretensión,” en esta teoría, debe ser entendida como aquel acto o conducta realizado con posterioridad a otro anterior, que está dirigido a obtener de otro sujeto un comportamiento determinado.
Los elementos o requisitos exigidos para la aplicación de este principio son:
a) Una relación o situación jurídica preexistente, por ejemplo un contrato;
b) Una actuación de una de las partes (conducta vinculante), que suscite en la otra parte una expectativa legítima seria que el comportamiento futuro de la primera será coherente con aquella actuación original.

In criminal law, for a given actus reus ("guilty act"), the required element to prove intent consists of showing mens rea (mental state, "guilty mind").
The requirements for the proof of intent in tort law are generally simpler than criminal law. Knowledge of the repercussions of the act is often not necessary. It is sometimes only a matter of showing that there was desire to perform an act.
