「先の出願としての利益」とは
また、パリ条約による優先権は、パリ条約の同盟国民（例えば米国人）が同盟第１国（例えば米国）にした正規かつ最先の出願に基づいて、同盟第2国（例えば日本）に所定期間内にパリ条約による優先権を主張した場合、同盟第1国の出願内容に含まれる同盟第2国出願のクレームは、同盟第1国の出願日を基準にして審査をしてもらえるという利益が与えられるものです。これに対して、国内優先権は日本国内の先の出願に基づいて国内優先権主張出願を行った場合に、先の出願内容に含まれる国内優先権主張出願のクレームは、先の出願日を基準にして審査をしてもらえるという利益が与えられるものです。
