Hallo,

es geht immer noch um einen Arbeitsvertrag.

Bei Beendigung des Anstellungsverhältnisses sind alle dem Arbeitnehmer überlassenen betrieblichen Unterlagen und das sonstige Firmeneigentum, sowie von dem Arbeitnehmer ***in Erfüllung seiner Dienstpflichten*** gefertigte Abschriften oder Kopien von Unterlagen herauszugeben. Entsprechendes gilt für Gegenstände und Unterlagen, die der Arbeitnehmer lediglich anlässlich seiner Tätigkeit erlangt hat.

Die Formulierung ***in Erfüllung seiner Dienstpflichten*** klingt für mich nach einem Beamten. Es handelt sich bei dem Arbeitnehmer allerdings "nur" um einen neuen Sales-Mitarbeiter.

Es handelt sich bei der Quelle um eine recht gebräuchliche Formulierung. Wenn man alles nur irgend denkbare hineinschreibt, kann man auch nichts vergessen, selbst wenn es für die betroffene Position nicht wirklich relevant ist.

Das sonstige Kopieren von Unterlagen (für den privaten Gebrauch) ist sicherlich an anderer Stelle verboten und kann zu arbeitsrechtlichen Schritten führen, daher die Unterscheidung "in Erfüllung der Dienstpflicht".
