Company registration not separate from the courts Whether or not a judge is involved is not relevant here. The point I wish to make is simply that in Germany (without wishing to speculate on the position in other countries) the "handelsregister" i.e. the Commercial Register is kept by the local courts. There is no other public authority involved.

accordingly, there is no necessary contradiction for a court official (of whatever rank) to be involved in the issuing of commercial register documents.

Even if a Judge "supervises" Company registration in Germany (and we don't know whether the text is from Germany) my understanding would be that he/she only becomes involved with complex or contested issues. I don't think we should assume that the Justizhauptsekretär is anything more than a Senior Legal Secretary in the Company registration office - probably a functionary who processes applications, vets them for legal accuracy and hands them to the Registrar for signing.

@ allegrotrans In Germany, company registration is handled by courts (non-contentious jurisdiction). Local courts also function as "Registergericht" i.e. court responsible for maintaining/supervising the register. Hence, there is not necessarily a contradiction in having judicial officials involved in company registration matters. HTH.

Senior judicial clerk? Maybe' senior judicial clerk' may be better to avoid the confusion with the other obvious meaning of secretary (cf, clerk of the court). 'Senior judicial registrar' might also be possible.

is there a judge around or it is only a legal position (judicial presumes court of law business) - whereas legal can also deal with anything that lawyers do.
