Birtokvitás eset: Possession disputes, vagy hosszabban disputes relating to possession claims.
A "birtok" itt "birtoklás" értelemben használt, nem "földbirtok" (land property) vagy "ingatlan" (real property) értelemben, bár azok birtoklását (possession) illetve tulajdonlását (ownership) célozza.
"26. § A *birtokvita* eldöntéséhez szükséges tényeket annak a félnek kell bizonyítania, akinek érdekében áll, hogy azokat a jegyző valónak fogadja el.
A jegyző a felek tényállításaira és az általuk tett bizonyítási indítványokra alapozva folytatja le a bizonyítást.
A *birtokvédelmi* ügyben releváns tényeket a Korm. rendelet 4. §-a példálózó jelleggel külön is szabályozza.
4. § A *birtokvita* eldöntéséhez szükséges tényállás megállapítása során a jegyző a bizonyítást kérelemre folytatja le. A bizonyítás a felek kérelme alapján kiterjedhet
a) a tényleges *birtokállapotra*,
b) az eredeti birtokállapotra,
c) a birtokos és a birtokháborító személyére,
d) a kérelmező tűrési kötelezettségére,
e) a tilos önhatalom gyakorlására,
f) törvényben meghatározott esetben a *birtoklás* jogcímére,
g) az eredeti birtokállapot helyreállításának célszerű módjára és
h) a hasznok, károk, költségek mértékére és viselésére."

Section 115
(1) Ownership claims shall not lapse.
(2) Pursuant to the property protection regulations, an owner may arbitrarily restrain or prevent any and all illegal intrusion or influence that impedes, restricts, or obliterates the exercise of his ownership rights.
(3) An owner may demand the termination of illegal intrusions or influences and, if things have been removed from his possession, to have them returned.
Section 116
(1) The owner of a real property, if he has acquired ownership outside the property register, may request to have his ownership indicated in the property register.
(2) If other legal regulations do not make exceptions, the property register shall be deemed authentic certification of the existence of ownership and other entitlements.
(3) The detailed provisions on property registration are prescribed in a separate legal regulation.

: Szerintem nem szabad keverni a jogi fogalmakat. "Property" : tulajdon, "property right" : tulajdonjog(i); a *birtok* viszont itt "possession". Nem "földbirtokról" van szó, hanem *birtoklásról* - to possess > possession
