French term

exploitation de publicité

French to English Bus/Financial Business/Commerce (general) terms of Use for internet
in the following context:

Vous n'aurez en aucun cas le droit de chercher ou avoir le droit à obtenir une annulation, injonction ou autre remède équitable ou qui engage ou restreigne le fonctionnement du Service, **l'exploitation de toute publicité** ou d'autres matériaux émis concernant les présentes ou le fonctionnement du Service ou tout autre contenu ou matériel utilisé ou affiché via le Service.

"Exploitation" seems so ambiguous in this context. Would "advertising campaign" seem too far-fetched?

When entering new questions, KudoZ askers are given an opportunity* to classify the difficulty of their questions as 'easy' or 'pro'. If you feel a question marked 'easy' should actually be marked 'pro', and if you have earned more than 20 KudoZ points, you can click the "Vote PRO" button to recommend that change.

How to tell the difference between "easy" and "pro" questions:

An easy question is one that any bilingual person would be able to answer correctly. (Or in the case of monolingual questions, an easy question is one that any native speaker of the language would be able to answer correctly.)

A pro question is anything else... in other words, any question that requires knowledge or skills that are specialized (even slightly).

Another way to think of the difficulty levels is this: an easy question is one that deals with everyday conversation. A pro question is anything else.

When deciding between easy and pro, err on the side of pro. Most questions will be pro.

* Note: non-member askers are not given the option of entering 'pro' questions; the only way for their questions to be classified as 'pro' is for a ProZ.com member or members to re-classify it.

Discussion

Wolf Draeger Apr 30, 2012:
Exploitation = use of As I see it, the text essentially means that the website claims absolute ownership of all content posted on its pages (incl. advertising), which it is subsequently free to use for-profit. Nothing can be removed by users or complainants, it all belongs to the site.

Maybe try something along the lines of:
"...no right to...modify or obstruct the use of the Service/Site, advertising or other content posted...or any other content used by or posted to the Service/Site"

"exploitation" I think might have a negative sense here so I'd keep it simple as it's "concernant ces présentes"

probably should have been more explicit in explanation. See Wolf's excellent point in dicussion and his alternative rewording.

By "negative" I mean the connotation that attaches to "exploitation of..." which would be inappropriate here

agree Wolf Draeger : Might need rewriting, but "use" is correct

many thanks Wolf. Absolutely agree with your discussion entry as that is the way I read this as well. Nothing to do with a campaign, it's a contractual point.
neutral liz askew : On the contrary, IMHO, "exploitation" does have a negative sense here.

what can I say? IMHO, I disagree with you on your reading of this.

Academics and practitioners are currently divided on the issues involved in permitting and regulating the commercial exploitation of publicity. "Publicity" is the practice of using an individual's name, image and reputation to promote products or to provide media coverage, often in gossip magazines and the tabloid press. This book provides a theoretical and multi-jurisdictional review of the nature of publicity practice and its appropriate legal regulation. The book includes a detailed exploration of the justifications advanced in favour of publicity rights and those that are advanced against. Removing the analysis from any one jurisdiction the book examines current academic and judicial perspectives on publicity rights in a range of jurisdictions, drawing out similarities and differences, and revealing a picture of current thinking and practice which is intellectually incoherent.
