recourse claims/actions Explanation: a rivalsa in the context of insurance means a situation in which the insurer pays out to the injured party, but then goes and recovers the money from the insured party because the latter did not comply fully with the policy terms. An example would be in motoring insurance when the accident is caused by the unroadworthy nature of the vehicle: the insurance still pays out to the injured party since it is still valid, but the accident was the fault of the insured party for driving an unroadworthy vechicle. Some policies pay out all the time but others have an exception for this. BTW, ricorsi I would see as appeals/chalenges rather than claims |

La rivalsa può comportare per l'assicurato spese molto elevate. Nel contratto assicurativo ci può essere la "rinuncia alla rivalsa" ed in questo caso deve essere inserita in polizza un’apposita clausola che, ovviamente, ha un costo supplementare. Nell'ambito della valutazione personale che ognuno fa all'atto della stipula di un contratto assicurativo, alle clausole di rivalsa previste dal contratto spesso non viene dedicata la giusta attenzione, anche perché nella marea di norme ed informazioni più o meno utili che vengono fornite, a volte vengono perse di vista. |
