sono in difficoltà con questo termine nel contesto che segue:
XXX shall have the right at any time to terminate this Agreement on the occurrence of any of the following events: (i) if the END USER commits breaches; (ii) if the END USER becomes or is deemed to be insolvent or unable to pay its debts, or enters into liquidation whether compulsorily or voluntarily or compounds with its creditors generally or has a receiver over all or any part of its assets or any proposal is made for a company voluntary arrangement in respect of the END USER.

Il decotto non può transigere e i creditori non terranno conto della sua transazione.
Tuttavia cessante fraude et calunnia può il decoctus transigere e la transactio è valida. Così pure è valida la transactio che il decotto compie per
utilità dei creditori e che non verga in nome e per conto proprio ma per l'utilità dei creditori.
