"I am often asked about the skilled man. The man skilled in the art is crucial to Patent law. The claims of a patent must be understood as if read by an expert in the field. As Jacob J said in the Rockwater case "the court must don the mantle of the skilled man". The skilled man has statutory recognition as can be found in Articles 56, 83 and 100 of the EPC which refer to "the person skilled in the art."
pytanie ma oczywiscie bezposredni zwiazek z powyzsza wypowidzia, zreszta ta wypowiedz jest cytowana/parafrazowana w inyternecie setki razy, np.

IMO what it basically means is that the court, by 'putting on the specialist's mantle' - will see the matters through specialist's eyes/his perspective

Metafora jak matafora, po angielsku tez brzmi dosc wymyslnie, bardzo ozdobnie i starodawnie, nie kazdy od razu to zalapie.

Jeśli istniej obawa, że czytelnik mógłby nie zrozumieć przenośni, to można coś dodać, na przykład "krawcy szyjący togi utkane z wiedzy", "krawcy wytwarzający togi (u)szyte z wiedzy" itp.
