The enforceability of these clauses varies from State to State. When the last sentence mentions 'solicitud', it is referring back to the beginning of the sentence "no contratará o solicitará'. 'Mientras' in this context I take to mean 'as long as', 'on the condition that', or 'on the proviso that'. I think that because it is a non-solicitation clause, the word 'solicitation' needs to be in there. What they're basically saying is that if one of the parties to the contract wants to hire staff currently employed by the other party, this must be done by way of prior notification and in the member of staff's free time (not during working hours). |
