What I still don't get though, how can you as an employer be obliged to (exercise a right to) exploit your employees' work results? (By the way, I think Einsatz/Gebrauch is use, which includes maybe just playing them back on some event, not necessarily for payment, whereas exploitation is Verwertung, which mainly means selling them for payment in some form or another). You are entitled to exercise a right so but as regards being obliged to ... I find it hard to make the transfer from license law where this does seem to fly (make sense) to the law of employee inventions right now but then ... maybe I do not work frequently enough in this --rare-- sub-field of IP. |

Whereas I still don't find it fully plausible (why would you want to point out that an almost irrelevant obligation (in terms of its practical implementation) does not apply in your agreement?) I now do see it as a promising starting point for discussion. |
