@ Sebastian - Yes, sorry, I did of course mean to the higher court. I cut things down too much in my efforts not to reveal your source.

Yes, only that the Regional Court refers the matter/legal issue (this depends on the specifics of the case) to the higher court mentioned earlier (in the previous sentence) for a ruling, not to the Advocate General.
