Italian term

anticipando il merito

Italian to English Law/Patents Law (general) Legal proceedings
Hi, I understand that the jurisdiction is affirmed on the basis of the objective assessment of the plaintiff's application but I don't know how to translate the 'anticipando in merito'. Any help would be appreciated. Thanks in advance
non è anticipando il merito, ma sulla base di una oggettiva valutazione della domanda attorea, e quindi in modo conforme all'art. 5 c..p.c. che deve essere affermata nella specie la giurisdizione

anticipating the merits (meritoriousness of the case)

il and not in merito.

On consideration of the venue or 'forum conveniens', the court will not jump the gun and prejudge the merits or unmeritoriousness of the case.

UK courts often do something slightly different with an application for an (E&W)W injunction > (Scots) interdict, namely judge whether there is a prima facie or hopeless case.
