bill of sale abs. & cond. vs. bailment @ Liviu R. Multumesc, Liviu! In fact a UK bill of sale can be twofold: a B of S *absolute* (as in the US) e.g. for a painting, TV set or a car and a conditional B of S by way of (chattel) *mortgage* that is registrable at the High Court in London.

A bailment (see the question headline) would include, for instance, keeping of a bailor's motor car at a bailee's garage for repair or refitting.

Either way, I guess your liens and en/incumbrances works, so suggest you post such as an answer.

PS the words 'sequestration' (BTW meaning bankruptcy in Scots law or escrow) and 'pursuit' (litigation) of a car started my loud Swiss civil law bells ringing - hence my answers.

Hi Adrian, here is the definition of interpleader:
Interpleader is a form of equitable relief. Equitable remedies are ways for courts to enforce rights other than by issuing a judgment for money damages. Interpleader is employed when two or more parties seek ownership of money or property that is held by a third party.

unlike in other parts of the world, the Americans have a very simple way to word a bill of sale for a car. Just mention that the car is free of liens and encumbrances, clear title and price.

I'll leave Liviu R. to post his US spin on the question. But I know that interpleader is also a US federal state process.

I reckon this is akin to the French-type 'séquestre' as an escrow, receivership or 'interpleader' (property held by an agent in a dispute over ownership) scenario vs. impounding (Scots: poinding) rap.

'Interpleader is civil procedure that allows a plaintiff to initiate a lawsuit in order to compel two or more other parties to litigate a dispute. An interpleader action originates when the plaintiff holds property on behalf of another, but does not know to whom the property should be transferred.'
