Hello, I have a Supply Contract and come across this phrase. Does it mean that the Contractor waivers his right to any claims? Too much translating and I cannot find the right wording. Thanks !

Exceptional false friends As I have tried to highlight, eccezione rarely in this context - or in any other Romance language - means an exception, but rather an objection. protest or defence.

As Adrian's references show, we've had this question before, so there's probably no point discussing it again. But this is a very roundabout way of saying "without exception".

Exception in most Romance languages (generally) means a plea or (BrE) defence / (AmE) defense. In UK statutes, exception means an exemption from a rule, evidentiary or otherwise.

The present participle is waiving and not waivering - wavering (or havering in Scottish, besides meaning talking nonsense!) - denotes hesitation.

A defence in this case of contract performance (execution means signing a contract vs. implementation or job completion) might include frustration of contract (impossibility) or split liability, namely trying to blame a joint contractor or a manufacturer of flawed tools, paint (famous English contract case) and equipment for a fault.

In Roman law terms, the defences to payment of the whole of a debt might include 'divisio et excussio' - namely splitting the debt with other co-debtors and a 'plea' for a creditor to sue the debtor (of money or performance of work) first before going for a guarantor.
