Data retention
Preservation is different to data retention, as the former relates to a targeted request to preserve the specific user's data under criminal investigation.
There are no mandatory data retention rules in the United States, or at European Union level, since the Data Retention Directive was declared invalid by the European Court of Justice in 2014. At the same time, data minimization requirements force SPs to delete data more quickly. This contributes to the volatility of e-evidence and results in less data being available for shorter periods of time, making the need for immediate preservation even more important.
