I also request the court to subpoena X as a witness

Subpoena

A subpoena is a written order to compel an individual to give testimony on a particular subject, often before a court, but sometimes in other proceedings (such as a Congressional inquiry). Failure to comply with such an order to appear may be punishable as contempt.

If you have received a legal document called a subpoena from a process server, it is important that you know what this paper is and what it means to you. A subpoena is an order issued by the court. The subpoena usually requires you to appear at a certain place, date, and time to testify as a witness about a particular case. In a criminal case, you can be subpoenaed only to testify in court. In a civil case, you may be subpoenaed for out-of-court testimony as well. In either kind of case, a subpoena may order you to provide documents.

What is a Summons?
A Summons is an official notice of a lawsuit. It is given to the person being sued. If you sue someone, they need to know about it. This way, they can come to court and fight the lawsuit. When you serve the defendant with a Summons, you officially tell that you are suing them. You must follow the rules for giving the Summons to the defendants to properly file your case. For helpful videos on filing court papers, see the Law Basics Video Series.

What is a Subpoena?
A Subpoena is a court order. You can use a Subpoena to require a person to come to court, go to a deposition, or give documents or evidence to you. You must serve the Subpoena on the person.

Differences in Their Purpose
The biggest difference between a summons and a subpoena is the purpose of the document. One is issued as a way to notify an individual of an upcoming case, while the other is issued as a way to obtain some type of information or evidence.

Peer comment(s):

agree David Knowles : Not sure "subpoena" is needed here - won't "call" or "summon" do? "Subpoena" implies unwillingness on the part of the witness, and I'm not sure that's the case here.

Thank you, David. Summons and subpoena serve different purposes, as explained in my answer box above.
