Section 1 of the Murder (Abolition of Death Penalty) Act 1965 abolished the separate category of capital murder, and all murders now carry the mandatory penalty of imprisonment for life. Northern Ireland In Northern Ireland, this offence was created by section 10 of the Criminal Justice Act (Northern Ireland) 1966. On the trial of an indictment for capital murder, the jury could not return an alternative verdict to the offence charged in that indictment under section 6(2) of the Criminal Law Act (Northern Ireland) 1967. Sections 1(4) and (5) of the Northern Ireland (Emergency Provisions) Act 1973 read: (4) For the purpose of any proceedings on or subsequent to a person's trial on a charge of capital murder, that charge and any plea or finding of guilty of capital murder shall be treated as being or having been a charge, or a plea or finding of guilty, of murder only; and if at the commencement of this Act a person is under a sentence of death for capital murder, the sentence shall have effect as a sentence of imprisonment for life. (5) In this section "capital murder" means a murder which immediately before the commencement of this Act is a capital murder within the meaning of section 10 of the Criminal Justice Act (Northern Ireland) 1966.[3]

Sin embargo, si bien fue una práctica acorde con las características de un sistema en donde era necesario actuar de forma expedita, el tránsito hacia el Estado de derecho y el reconocimiento de las garantías individuales acrecentó el rechazo hacia esta manera de imponer justicia. En la mayor parte de los países occidentales se ha abolido de forma definitiva, pero en Estados Unidos varios estados todavía la incluyen en sus legislaturas. Así, esta investigación encara el debate en torno a la pena capital en dicho país, identificando los escenarios que han modificado tanto las características de la ejecución -que pasó de pública a privada-, como su percepción pública. This practice was in accordance to a system which required swift justice. The appearance and development of the rule of law in which individual rights were recognized increased the opposition to this measure. Capital punishment has been abolished in almost all Western countries, but in the case of the United States many local legislatures include death penalty statutes. This paper has the purpose of approaching the ever-changing debate surrounding this practice in the United States, in order to review different sceneries that have modified both how the executions take place, replacing public executions in favor of private ones, and the public perception regarding them.
