1. The Mother’s legal representative – contrary to the actual finding of the Court later on in their judgment – stated explicitly that the Abu Dhabi Civil Family Court did have jurisdiction to deal with the Father’s case (her exact words being “of course I have to accept that this Court does have jurisdiction to hear this case”) and Therefore her case was NOT that the Abu Dhabi Civil Family Court did not have jurisdiction but rather that they should defer to proceedings which she cited and described taking place in Dubai. This is a very important distinction, it is the difference between whether the forum exists and forum conveniens.
