While the traditional rule in state court has been that a third-party claimant is not a proper party to a declaratory judgment action (at least until such time as the third-
party claimant becomes a judgment creditor), the Supreme Court of Texas has
implied that third-party claimants may have an interest in declaratory judgment actions.
