Source text - French L'article L121-4 du code de la route prévoit que les auteurs (français et a fortiori étrangers) d'une contravention au code de la route qui ne peuvent payer immédiatement l'amende et qui sont dans l'impossibilité de :
• justifier d'un domicile ou d'un emploi sur le territoire
français
• ou de justifier d'une caution agréée par l'administration
(par exemple : automobile-club, touring-club)
peuvent faire l'objet d'une "consignation" d'argent dont le montant est fixé par l'arrêté du 19 décembre 2001. La décision imposant cette consignation est prise par le Procureur de la République dans un délai de 24 heures après la constatation de l'infraction. Si aucune de ces garanties n'est fournie par l'auteur de l'infraction, le véhicule pourra être mis en fourrière et les frais en résultant seront mis à sa charge.
A savoir : en cas d'infraction commise par le titulaire d'un permis de conduire délivré par un etat membre de la Communauté européenne, l'échange du permis de conduire étranger contre un titre français est obligatoire.
Translation - English Article L121-4 of the highway code states that the perpetrators (French as well as foreign) of a violation of the highway code who are not able to immediately pay the fine and who find themselves unable:
• to prove a domicile or employment on French territory
• or to prove a guarantee of payment authorized by
the government (for example : automobile or touring
club)
can be subjected to a deposit of money for which the amount is fixed by the law of December 19th, 2001. The decision to impose this deposit is made by the state prosecutor within 24 hours after the ascertainment of the infraction. If none of these guarantees are furnished by the perpetrator of the violation, the vehicle may be impounded and the resulting costs will be his responsibility.
Note : in the case of a violation committed by a holder of a driver’s license issued by a state member of the European Community, the exchange of the foreign driver’s license for a French license is obligatory.
