Artikel 117 der Geschäftsordnung
Betrifft: Verbrauchsteuerechtlich bedingte Schwierigkeiten beim grenzüberschreitenden Spirituosenhandel
Österreichische Betriebe berichten über, aus dem Verbrauchsteuerrecht resultierende Schwierigkeiten bei der Lieferung von (bereits in den freien Verkehr überführten) Spirituosen zu gewerblichen Zwecken nach Deutschland. Gemäß Artikel 33 (3) der Richtlinie 2008/118/EG über das allgemeine Verbrauchsteuersystem ist Steuerschuldner der zu entrichtenden Verbrauchsteuer entweder die Person, die die Lieferung vornimmt oder in deren Besitz sich die zur Lieferung vorgesehenen Waren befinden oder an die die Waren im anderen Mitgliedstaat geliefert werden. Als Steuerschuldner kommt damit nach der Richtlinie 2008/118/EG alternativ eine der in Artikel 33 (3) genannten Personen in Betracht. Demgegenüber bestimmt das deutsche Branntweinmonopolgesetz in § 149 für den Versandhandel ausschließlich den Bezieher der Waren zum Steuerschuldner. Da deutsche Abnehmer kleiner Mengen (Restaurants, Pubs, etc) nicht bereit sind, die resultierenden administrativen Pflichten auf sich zu nehmen, werden weniger Spirituosen aus dem EU-Ausland bezogen und werden österreichische Hersteller und Händler kleiner Mengen de facto vom deutschen Markt ausgeschlossen. Anders als früher können österreichische Hersteller bzw Händler nicht mehr als Steuerschuldner fungieren und dadurch ihren deutschen Kunden administrative Belastungen abnehmen.
1. Sind der Kommission die geschilderten Probleme bekannt?
2. Verstößt es gegen die Richtlinie 2008/118/EG, im Versandhandelsfall ausschließlich den inländischen Bezieher von (bereits in den freien Verkehr überführten) EU-ausländischen Spirituosen zu gewerblichen Zwecken als Steuerschuldner zu bestimmen?
3. Falls kein Verstoß gegen die Richtlinie 2008/118/EG vorliegt, welche Schritte ergreift die Kommission um sicherzustellen, dass das Verbrauchssteuerregime den grenzüberschreitenden Handel mit geringen Mengen an Spirituosen nicht unverhältnismäßig belastet und damit unwirtschaftlich macht?

Oggetto: Le difficoltà causate dall'applicazione dell'accisa nel commercio internazionale di liquori
Le aziende austriache segnalano le difficoltà risultanti dall'applicazione dell'accisa in relazione alla fornitura di liquori (già immessi in libera pratica) per scopi commerciali verso la Germania. Ai sensi dell'articolo 33 terzo comma della direttiva 2008/118/CE relativa al regime generale delle accise, il debitore dell'accisa divenuta esigibile è o la persona che effettua la fornitura, o la persona che detiene i prodotti destinati ad essere forniti, o alla quale i prodotti sono forniti in un altro Stato membro. Debitore di imposta è pertanto, ai sensi della direttiva 2008/118/CE, alternativamente una delle persone menzionate nell'articolo 33 terzo comma. Per contro, l'articolo 149 della legge tedesca sul monopolio dell'alcool individua, in caso di vendita per corrispondenza, esclusivamente l'acquirente del prodotto quale debitore di imposta. Poiché gli acquirenti di piccole quantità (ristoranti, pub ecc.) non sono pronti ad assumersi le funzioni amministrative da ciò risultanti, vengono acquistati meno liquori nei paesi extra UE, mentre i produttori austriaci e i commercianti di piccole quantità vengono di fatto esclusi dal mercato tedesco. Diversamente da prima i produttori austriaci e i commercianti non possono più fungere da debitori di imposta, eliminando quindi per i clienti tedeschi gli oneri amministrativi a loro carico.
1. Sono noti alla Commissione i problemi illustrati?
2. Individuare, in caso di vendita per corrispondenza, esclusivamente l'acquirente nazionale quale debitore di imposta, per scopi commerciali e in materia di liquori (già immessi in libera pratica) e provenienti da paesi extra UE, porta alla violazione della direttiva 2008/118/CE?
3. Qualora non si sia in presenza di violazioni della direttiva 2008/118/CE, quali sono le misure adottate dalla Commissione per assicurare che il regime delle accise non risulti eccessivamente oneroso nei confronti del commercio internazionale di piccole quantità di liquori, cosa che lo renderebbe antieconomico?

Subject: EU-Serbia relations and the capture of Ratko Mladić and Goran Hadžić
The Serbian Government has recently announced a tenfold increase in the reward for information leading to the capture of wartime Bosnian Serb General Ratko Mladić (€10 million as against the €1 million set in 2007) and a fourfold increase in its reward for information leading to the arrest of Goran Hadžić (€1 million). This news came just a few days after the General Affairs Council meeting (Luxembourg, 25 October 2010) during which the Council asked the Commission to submit its opinion on the application of the Republic of Serbia for membership of the European Union. The Council also called ‘upon Serbia to implement recommendations presented by the ICTY Office of the Prosecutor to the United Nations Security Council in June 2010 concerning Serbia’s support in ongoing trials and appeals and Serbia’s assistance in the key matter of the arrest of the two remaining fugitives, Ratko Mladić and Goran Hadžić, which would be the most convincing proof of Serbia's efforts and cooperation with the ICTY.’ During a recent appearance with Serbian President Boris Tadić, US Secretary of State Hillary Clinton stated that she believed that Serbia was making efforts in good faith to arrest the wartime fugitives and underlined that the effort ‘should be recognised by others.’ The US has offered a reward of up to $5 million for information on Mladić's whereabouts.
In the opinion of the Council, what can the EU do to help Serbia apprehend Ratko Mladić and Goran Hadžić? What efforts are currently being made in this respect? How can the European Union facilitate Serbia's efforts to deal with this difficult issue and augment its integration with the EU?

Oggetto: Relazioni tra l'UE e la Repubblica di Serbia e cattura di Ratko Mladić e Goran Hadžić
Il governo serbo ha recentemente annunciato di avere decuplicato la ricompensa a favore di coloro che forniscono informazione che possano consentire la cattura di Ratko Mladić, generale dell'esercito serbo bosniaco all'epoca della guerra (10 milioni di euro rispetto ad 1 milione di euro posto come ricompensa nel 2007) e di avere quadruplicato la ricompensa per le informazioni fornite per la cattura di Goran Hadžić (1 milione di euro). Questo annuncio segue di pochi giorni la riunione del Consiglio Affari generali (25 ottobre 2010, Lussemburgo) durante la quale il Consiglio ha richiesto alla Commissione di sottomettergli la sua opinione in relazione alla domanda di adesione della Repubblica di Serbia all'Unione europea. Il Consiglio ha invitato la Repubblica di Serbia ad implementate le raccomandazioni presentate dall’Ufficio del procuratore del tribunale penale internazionale per l’ex Jugoslavia (ICTY) al Consiglio di sicurezza delle Nazioni Unite nel giugno del 2010 riguardanti il supporto fornito dalla Repubblica di Serbia ai processi in corso e l'aiuto che la stessa deve prestare in relazione alla cattura dei due latitanti ancora in circolazione, Ratko Mladić e Goran Hadžić; tale cattura rappresenterebbe la prova più convincente degli sforzi della Repubblica di Serbia nella cooperazione con l'ICTY. Durante un recente incontro con il presidente serbo Boris Tadić, il segretario di stato USA, Hillary Clinton, ha affermato di credere che la Repubblica di Serbia stia compiendo seri sforzi per arrestare i fuggitivi dell'epoca della guerra ed ha sottolineato che questo "dovrebbe essere riconosciuto da altri." Gli USA hanno offerto una ricompensa fino a 5 milioni di dollari per informazioni sulla posizione di Mladić.
In che modo può la UE, a parere del Consiglio, aiutare la Repubblica di Serbia a catturare Ratko Mladić e Goran Hadžić? Quali sono gli sforzi compiuti sino ad oggi a tal fine? Come può l'Unione europea facilitare gli sforzi compiuti dalla Repubblica di Serbia per affrontare questa spinosa questione ed aumentare la sua integrazione con l'UE?
