Não cabe ação rescisória, se extinto o processo sem ***exame do mérito***. Assim, por exemplo, se o juiz o extinguiu por falta de pressuposto processual ou por falta de condição da ação. A razão, aí, é bastante clara. A extinção do processo, sem exame do mérito, não obsta a que o autor intente de novo ação (CPC, art. 268).

a review on the merits
"Review on the merits" is a commonly used term in U.S. court proceedings that means to look at a case based upon the subject matter -- what actually took place -- rather than, say, some procedural issue such as jurisdiction. For confirmation, google "review on the merits" (not to be confused with "review oF the merits" ... There can be a review on the merits or a judgment on the merits.
