"..., dass die Beschaffung des Kaufpreises und etwaiger Darlehen, die zur Kaufpreiszahlung benoetigt werden, einschliesslich der rechtlichen Voraussetzungen fuer die Darlehenssicherung Sache der Kaeuferin ist, insbesondere hat der Notar auf die kurzfristige Bestellung von Grundpfandrechten hingewiesen, da die Kreditinstitute in der Regel erst nach Eintragung der fuer sie bestellten Grundpfandrechte Auszahlungen taetigen,..."

This has been entered in the glossary as both "mortgages" and "charges on real property." I guess the question I have is if I opt for the latter, it would be more encompassing and thus more desirable?

Depends upon your readership.
Most people in the States would not understand "charges on real property."

charges on real property

I would go with this term although I agree with Fred that most people in the US would not know what it is. At least, these people will be warned sufficiently that this must be something according to German law and that there is no equivalent in US law.

This term designates best (in my opinion) what the German term "Grundpfandrechte" encompasses, namely, Hypotheken (mortgages), Grundschulden (an "in rem" charge on the real estate)and "Rentenschulden". "Hypotheken" are "akzessorisch", i.e. they depend on the underlying claim (loan), "Grundschulden" (at least if they are not "Sicherungsgrundschulden") do not.

See Creifelds, Rechtswörterbuch:
"Grundpfandrechte sind dingliche Rechte, die zur sicherung einer forderung auf einem grundstück ruhen durch sie kann das Grundvermögen zu Kreditzwecken belastet werden. Als Grundpfandrechte kennt das BGB die Hyupothek, Grundsschuld und Rentenschuld."


But just for your information: Black's Law Dictionary states, inter alia: "Mortgage ....The mortgage operates as a conveyance of the legal title to the mortgagee.... The above definitions are applicable to the common-law... conception of a mortgage...But in many states, a mortgage is regarded as a mere lien, and not as creating a title or estate." The word "lien" is used in contrast to the "conveyance of legal title".

Although the term "lien" might be an option, I would not use "lien" because this term is usually used in connection with claims other than a credit granted, e.g.: achitect's lien, judgment lien, materialman's lien.

"liens" is broad enough to include essentially everything other than mortgages.
