Esto aparece en una autorización de viaje para un menor en Venezuela. He estructurado el documento en una serie de frases que comienzan con "whereas" para hacer más sencilla su comprensión en inglés. Es por ello que para traducir esta frase estoy buscando un sustantivo para reemplazar los signos de interrogación que coloco abajo:

"...visto el número de veces en la cual este Tribunal fijó diferentes oportunidades con la finalidad de que las partes pudieran llegar a un acuerdo en la presente solicitud, siendo infructuoso debido a la incomparecencia de estas a las audiencias..."

Hasta ahora, he colocado:

"whereas this Court set several dates for the parties to reach an agreement regarding this request; whereas said **???** were unsuccessful, due to the failure of the parties to appear at the hearings..."

Yvonne, in this case, I've just withdrawn my answer and I would confirm what I would definitely say, as below: "...and considering/given the number of times... , which could not be reached due to these parties not appearing...". Hope this helps or clarifies things a bit.

Hi Yvonne, In this particular case, I would simply suggest "...considering the number of times that this Court..., which (agreement) could not be reached... I'd need to know what cam before this part of the sentence to be 100%, but I, personally, would not use "whereas" which means "mientras que", "en tanto que".

Yvonne, con o sin gerundios, femeninos o masculinos, el texto original sufre de 'legalitis', cosa muy común en los textos legales. No porque lo prepare un juez dejan de ser gramaticalmente incorrectos. Claramente, este tribunal ha intentado lograr un acuerdo entre las partes, y ha intentado citarlas para que comparezcan a llegar a dicho acuerdo. Estos intentos del tribunal han sido infructuosos porque las partes no han comparecido, por lo tanto, el intento de llegar a un acuerdo a su vez ha sido infructuoso. Dado que no hubo reunión, no hay acuerdo.

Repito lo que he dicho arriba; esto no tiene que ver con masculinos/femeninos, el texto original sufre de 'legalitis', cosa muy común en los textos legales. Claramente, este tribunal ha intentado lograr un acuerdo entre las partes, y ha intentado citarlas para que comparezcan a llegar a dicho acuerdo. Estos intentos o esfuerzos del tribunal han sido infructuosos porque las partes no han comparecido, por lo tanto, el intento de llegar a un acuerdo a su vez ha sido infructuoso. Dado que no hubo reunión, no hay acuerdo. No podemos hablar de un acuerdo 'infructuoso' cuando ni siquiera se llegó a la mesa a firmar dicho acuerdo. Como diríamos en mi país, 'se cae de la mata.'

agree Richard Boulter : 'Infructuoso' being masculine, it clearly refers to 'number (of efforts/attempts)', which translates better into English by making 'efforts/attempts' the subject.

Additional possible wording. Such an arrangement made by means of a 'judicial finding' and a 'court order ' order can be termed 'dispositions' in U.S. legalese. The words suggested for 'infructuoso' are fine, and 'fruitless' is added as a very fluent expression of the concept; others for this could be 'in vain', 'unavailing', 'frustrated', 'rendered moot', etc.

A number of dates were set by the Court in an effort to reach an agreement regarding this request, all of which were unsuccessful due to the failure of the parties to appear at the hearings.

Another rewording which may help. I also liked Taña´s "non-appearance" for "incomparecencia". Saludos :)

'them' here is "oportunidades".
