The Constitutional Court decided not to close down the AK Party for various reasons including:
- the majority of the Turkish people describes the activities of the AK Party as legitimate since 2002.
- the efforts to join the European Union continue with legal and political reforms.
- capital punishment has been removed from Turkish laws.
- international agreements surpass the authority of the constitution and domestic laws.
