difference between procedural and material claims From Kubo E's link, this is what I get. "Streitgegenstand" is "matter in dispute".

Kubo's link says when a judicial matter comes up, there's a material right claim and there's a procedural right claim that the court uses. These are the two appendages of this "concept." Just what I've come up with.

oder prozessualer Anspruch ist im Zivilprozeß die Bezeichnung für den Gegenstand eines gerichtlichen Verfahrens. Wie der S. zu bestimmen ist, ist umstritten.
Herrschend ist die sog. Theorie vom zweigliedrigen Streitgegenstandsbegriff, wonach für dessen Bestimmung sowohl der vom Kläger in der Klageschrift gestellte Antrag als auch der hierzu vorgetragene Lebenssachverhalt maßgebend ist."
