maybe even with the word "potentiële" in there somewhere

Not sure if this is correct, … but it is being translated as "Strafbefehl" (German) here:

"In the case of a decision of a public prosecutor or a court not to prosecute or to discontinue the prosecution of an offence that is the subject of an extradition request, this decision and the reasons for which it was taken also have to be included in the balancing exercise.
The same applies if a court has decided that a case has to be tried in full or that it has handed down a written penal notice (Strafbefehl).(85)

"9 Davidoff brought proceedings against Gofkid in Germany, seeking an order, with a penal notice attached, that Gofkid desist from using the Durffee mark and annulment of the mark. "
