Que la justicia interpreta como tal, por oposición a fuga real. Entiendo que "constructive" aquí se relaciona con el verbo "construe", que significa "interpretar".

: Desconocía la existencia de esta expresión. Tu opción puede valer. No creo que exista una traducción asentada en el derecho continental de este concepto anglosajón. Yo simplificaría como "doctrina de la fuga sujeta a interpretación".
