Chapter I General Provisions
Article 1 In order to strengthen the protection and administration of the Huashan Mountain Scenic Spot and reasonably utilize the scenic resources, the Regulations on Huashan Mountain Scenic Spot of Shaanxi Province are formulated in accordance with the Regulations on the Administration of Scenic Spots by the State Council and inconsideration of the actual circumstances of the Huashan Mountain Scenic Spot.
Article 2 These Regulations shall apply to the planning, construction, protection, utilization and administration of the Huashan Mountain Scenic Spot.
The specific scope of the Huashan Mountain Scenic Spot and its external protective zone shall be identified in accordance with the General Planning of the Huashan Mountain Scenic Spot.
Article 3 The Huashan Mountain Scenic Spot shall adhere to the principle of “Scientific Planning, Uniform Administration, Stringent Protection and Sustainable Utilization”.
Article 4 The administrative department of housing and urban-rural constructions of the provincial people's government shall be responsible for the supervision and administration of the Huashan Mountain Scenic Spot.
Article 5 The Weinan People’s Government shall strengthen its leadership over the Huashan Mountain Scenic Spot and incorporate the protection and construction of the Huashan Mountain Scenic Spot into the planning of the national economic and social development.
The administrative authority of the Huashan Mountain Scenic Spot established by the Weinan People’s Government shall be specifically responsible for the protection, utilization and uniform administration of the Huashan Mountain Scenic Spot.
Article 6 The main responsibilities of the administrative authority of the Huashan Mountain Scenic Spot include:
(1) Publicize and implement the laws and regulations concerning the protection and administration of scenic spots;
(2) Participate in the formulation of and organize the implementation of the general and detailed planning of the Huashan Mountain Scenic Spot;
(3) Formulate and organize the implementation of the specific protection and administration system of the Huashan Mountain Scenic Spot;
(4) Organize the investigation, evaluation and registration of the resources of the Huashan Mountain Scenic Spot, and launch the image creation and publicity and tourist promotion;
(5) Protect the scenery and the ecological environment of the Huashan Mountain Scenic Spot;
(6) Establish, maintain and administer the infrastructure and public facilities of the Huashan Mountain Scenic Spot;
(7) Be responsible for the tourist security, the market order, the environment of the scenic spot and the sanitary administration of the Huashan Mountain Scenic Spot;
(8) Be responsible for the supervision administration of construction projects and relevant activities inside the Huashan Mountain Scenic Spot; and
(9) Performs other duties delegated by the Weinan People's Government.
Article 7 The Huayin People’s Government is responsible for the construction and administration of the external protective zone of the Huashan Mountain Scenic Spot.
Other people's governments at the county level surrounding the Huashan Mountain Scenic Spot shall, with a view to the actual circumstances, utilize the resources of the Huashan Mountain Scenic Spot, develop the tourist industry and promote the economic development of the county-level regions.
Chapter II Planning
Article 8 Carry out such activities as the construction, protection, utilization and administration of the Huashan Mountain Scenic Spot and its external protective zone, all of which shall adhere to the planning of the Huashan Mountain Scenic Spot.
Article 9 Planning of the Huashan Mountain Scenic Spot shall be divided into general planning and detailed planning, organized and formulated by the provincial administrative department of housing and urban-rural constructions. The general planning shall be submitted by the provincial people's government to the State Council for approval, and the detailed planning be submitted by the provincial administrative department of housing and urban-rural constructions to the administrative department of housing and urban-rural constructions of the State Council for approval.
The provincial administrative department of housing and urban-rural constructions shall make public the approved planning of the Huashan Mountain Scenic Spot.
Article 10 The general planning of the Huashan Mountain Scenic Spot shall include:
(1) Evaluation of scenic resources;
(2) Protective measures of ecological resources and cultural relics, distribution of major construction projects and intensity of exploitation and utilization;
(3) The functional structure and spatial distribution of the scenic spot;
(4) Areas of forbidden exploitation and restricted exploitation;
(5) Tourist capacity of the scenic spot;
(6) Relevant special planning.
The detailed planning of the Huashan Mountain Scenic Spot shall be formulated according to different requirements of core scenic spots and other scenic spots, and shall identify the sites, layout and scale of the infrastructure, tourist facilities and cultural facilities and establish the scope of construction land and the conceptual design conditions.
The detailed planning of the Huashan Mountain Scenic Spot shall adhere to the general planning of the Huashan Mountain Scenic Spot.
