Source text - English CONTINGENT FEE AGREEMENT
___________________________, hereinafter referred to as "Client," agrees to retain the attorneys of __________________________, P.L.L.C., hereinafter referred to as "Attorneys," and Attorneys agree to represent Client, upon the following terms and conditions:
1. Services Provided. Client retains Attorneys for legal representation regarding personal injury(-ies) sustained against __________________________________________________________, which occurred on or about ________________________________________.
2. Attorneys' Fees/Billing Practices.
Client elects to retain Attorneys upon a contingent fee basis, based upon the gross amount of recovery (whether by judgment, verdict or settlement) obtained for Client and computed as follows:
(a) Gross recovery means all amounts recovered whether they be designated as settlements, verdicts, awards, judgments, attorneys’ fees, costs, interest, or anything else. Attorneys' fees shall be calculated on the gross recovery before deduction of costs (including miscellaneous costs), payment of subornation interest or any other expenses. If recovery is made on an annuity or periodic payment basis, the attorney’s fees shall be computed on the present cash value of the total payments. Attorneys' fees shall be deducted from the initial cash settlement payment at Attorneys' sole option.
(b) If no recovery of funds is obtained in the claim or action, no fee will be payable to Attorneys.
(c) Attorneys' fee shall be one-third (1/3) of the gross amount received by compromise or settlement or judgment or other means of recovery.
(d) This fee agreement does not cover any appellate or other further work after one trial. Client and Attorneys must enter into another written, fee agreement to memorialize any work after the one trial.
3. Attorneys' Lien. Client grants Attorneys a lien on the proceeds of any cause of action pursued by Attorneys for Client to secure payment of costs, disbursements and Attorneys' fees incurred as provided above. Attorneys or anyone in possession of any such proceeds shall apply the proceeds towards payment of the Attorneys' fees and costs prior to distribution of any such proceeds to Client.
4. Collection Costs. In the event Client fails to pay all or part of the costs, disbursements or Attorneys' fees pursuant to this agreement, Attorneys shall be entitled to recover from Client all actual attorneys' fees and costs of collection and suit incurred by Attorneys in enforcing their rights herein, including all time spent by Attorneys in collection efforts at Attorneys' then prevailing rates. Client agrees that, in the event of a lawsuit between the parties to this Agreement, at Attorneys' option, venue shall lie in King County Superior Court.
5. Withdrawal. Attorneys reserve the right to withdraw from representing Client in accordance with Washington State’s Rule of Professional Conduct 1.15. In the event Client discharges Attorneys, Client agrees to pay Attorneys a reasonable attorney fee at Attorneys’ hourly rate at $250.00 and any unreimbursed costs. Calculation of a reasonable attorney fee shall not be limited to time expended or a percentage of the last offer received, but shall be based on those factors enumerated in Washington State Rule for Professional Conduct 1.5(a).
6. Advice Concerning Attorney Fees. Client has been advised that, as an alternative to this contingent fee arrangement, Client could employ Attorneys on an hourly basis. Under an hourly fee arrangement, Client would pay an advance retainer fee of $10,000 and hourly fees at the rate of no less than $250 per hour for an attorney’s time. In addition, the rate for law clerks would be $75 per hour and $50 per hour for paralegals/legal assistants. Client would have an ongoing obligation to maintain advances adequate to cover fees and costs incurred. Client has rejected this hourly fee arrangement and elects to pay Attorneys on the contingent fee basis stated herein.
7. Payment of Health Care Providers. Client authorizes Attorneys to pay any health care provider from Client’s share of any recovery, any unpaid balance due for services received for injuries sustained in the accident resulting in this claim.
8. Waiver of Physician Patient Privilege. Client acknowledges that the plaintiff in a personal injury action waives the physician patient privilege, allowing defendants to examine Client’s medical records and question Client’s medical providers. Knowing this, Client authorize Attorneys to waive Client’s physician patient privilege if a lawsuit is filed.
9. Associate Counsel. Attorneys reserve the right to associate other attorneys in Client’s representation, without additional expense to Client. Client consents to such association, and to a division of attorney fees as may be agreed upon between associated counsels.
10. Probate. In the event a death requires appointment of a personal representative and/or commencement of a probate action to prosecute Client's claims, Client authorizes Attorneys to retain counsel to handle the probate. Fees and expenses incurred in any probate proceedings shall be considered a cost item.
11. Power of Attorney. Client designates Attorneys, as attorney in fact to act for Client as the principal. Attorneys, as fiduciary, shall have all powers of an absolute owner to endorse, on behalf of Client, any check received from the resolution of the above-referenced claim set forth in paragraph 1 above.
12. Investigation. Client understands that Attorneys will investigate Client’s claims, and if Attorneys determine the claim to be lacking in merit or otherwise in appropriate to pursue, Attorneys shall have the right to cancel this Agreement, in which case Client will be responsible only for the costs or expenses incurred by Attorneys and will owe no Attorneys’ fee. Client acknowledges that Attorneys have made no guarantee regarding the outcome of the claim.
BY SIGNING BELOW, CLIENT ACKNOWLEDGES THAT CLIENT HAS RECEIVED AND READ A COPY OF THIS FEE AGREEMENT. CLIENT UNDERSTANDS THE AGREEMENT AND CLIENT AGREES TO ABIDE BY ITS TERMS AND CONDITIONS. WHILE ATTORNEYS MAY RENDER AN OPINION AS TO THE PROBABILITY OF SUCCESS OR FAILURE OF CONTEMPLATED ACTION, OR AN ESTIMATE OF FEES AND COSTS TO BE INCURRED, SUCH OPINION OR ESTIMATE IS NOT A GUARANTEE AND MAY CHANGE AS ADDITIONAL FACTS OR CIRCUMSTANCES BECOME KNOWN. THERE ARE NO OTHER ORAL OR WRITTEN FEE AGREEMENTS OR ARRANGEMENTS BETWEEN CLIENT AND ATTORNEYS RELATING TO THE MATTERS SET FORTH IN PARAGRAPH 1, ABOVE.

1. 제공되는 서비스. 의뢰인은 _______________________ 에게 ________________ 일경 입은 육체적 상해에 관련하여 법적 대리를 위하여 변호인을 고용한다.
2. 변호인 비용 결제 방법.
의뢰인은 변호인을 의뢰인이 받는 총 만회 금액 (판결, 평결 혹은 합의에 의한)을 기반으로 한 성공 사례금으로 고용하며, 아래와 같이 계산된다.:
(a) 총 만회라 함은 합의, 평결, 지급 판정, 판결, 변호사 수수료, 비용, 이자, 및 다른 모든 것들로 지정된 것에 의하여 만회된 모든 금액을 의미한다. 변호사 수임료는 비용 (기타 비용 포함), 대위 변제 이자 비용 혹은 모든 다른 비용을 제하기 전 총 합계 금액에서 산출된다. 만회 비용이 연금 혹은 정기 지급을 기준으로 하는 경우, 변호사 수임료는 총 지급액의 현재 현금 가치 금액으로 계산된다. 변호사 수임료는 변호사 단독 선택권으로 초반 현금 지급액에서 제한다.
(b) 만약 아무 만회 금액도 클레임이나 활동에 의하여 얻어 지지 않는다면, 변호인의 수임료는 지급되지 않는다.
(c) 변호사의 수임료는 타협, 합의 또는 판결 혹은 다른 만회 방법에 의하여 받은 총 금액의 삼분의 일로 한다.
(d) 이 수임료 계약서 항소나 한번의 재판 이후의 추가 작업은 포함하고 있지 않다. 의뢰인과 변호인은 한번의 재판 이후에는 어떤 작업이든 추가하기 위하여 다른 서면 수임료 동의서를 작성해야 한다.
3. 변호인의 선취특권. 위 서비스를 제공함으로써 발생한 비용, 지출 및 변호사 수임료의 지급을 담보하기 위하여 의뢰인은 변호인에게 변호인이 추진하는 소송 사유의 진행에 대한 선취특권을 부여한다. 이러한 소송을 진행 중인 변호인 혹은 누구든지 의뢰인의 수익을 분해하기 이전에 변호사 수임료 및 비용의 지급에 대한 진행이 우선적으로 적용된다..
4. 비용 수금. 의뢰인이 이 동의서에 따른 비용의 전부 혹은 일부, 지불금, 혹은 변호사 수임료를 지급하는데 실패하는 경우, 변호인은 모든 실질 변호사 수임료 및 회수 비용 및 강제로 변호인의 권리를 행사하는 데에 발생하는 소송 비용을 의뢰인으로부터 회수할 권리가 있으며, 변호인의 권리라 함은 변호인이 변호사 요금율에 의거한 회수를 위한 노력에 사용된 총 시간에 따른 비용을 포함한다. 의뢰인은 이 계약의 당사자 간의 소송의 경우, 변호사의 선택에 따라 장소는 킹카운티 상급법원에 위치한다는 것을 동의한다..
5. 철회. 변호인은 워싱턴 주 전문직 행동 강령1.15에 의거, 대리하는 의뢰인으로부터 의뢰 철회할 권리를 가진다. 의뢰인이 변호인을 해고하는 경우, 의뢰인은 변호인에게 시급 $250의 합리적인 수임료 및 다른 지급되지 않은 변제 비용을 지급하기로 동의한다. 합리적인 변호사 수임료의 계산은 소비 시간에 따라 혹은 마지막 제안의 비율에 따라 제한되는 것이 아니고, 워싱턴 주 전문직 행동 강령1.5(a)에 열거하는 요인에 근거해야 한다.

10. 공증. 사망의 경우, 의뢰인의 클레임을 추진할 소송을 시작할 개인 대리인 혹은 공증이 필요하며, 의뢰인은 변호인에게 공증을 담당할 변호인단을 꾸리도록 권한을 부여한다. 공증 절차에 따라 발생하는 수임료와 비용은 비용 항목으로 간주된다.
11. 변호인의 권한. 의뢰인은 변호인을 의뢰인 본인의 대리인으로 지정한다. 변호인은 수탁자로, 의뢰인을 대신하여 위 제1항에서 언급된 클레임의 결과로 받는 모든 수표에 배서할 절대 소유자의 모든 권한을 가진다.
12. 수사. 의뢰인은 변호인이 의뢰인의 클레임을 조사할 것을 이해하며, 만약 변호인이 클레임이 충분한 가치가 없거나, 추진하기에 적절치 않다고 판단하는 경우, 변호인은 이 계약을 취소할 권한이 있으며 이 경우 의뢰인은 변호인에 의하여 발생한 비용과 경비만을 지불할 책임이 있으며, 변호사 수임료는 지불하지 않는다. 의뢰인은 변호인이 이 클레임의 결과에 대하여 어떤 보장도 하지 않았음을 인정한다.
아래에 서명함으로써, 의뢰인은 이 수임료 계약서를 받았고 읽었음을 인정한다. 의뢰인은 이 계약서를 이해하며, 의뢰인은 이 약관을 따르기로 동의한다. 변호인이 고려되는 조치의 성공 혹은 실패에 대한 확률, 예상 수임료와 비용 등에 대한 의견을 제시할 수 도 있지만, 그런 의견 및 예측은 보장되지 않으며, 추가되는 사실 및 새로이 알려 지는 배경 사실 등으로 인하여 바뀔 수 도 있다. 의뢰인과 변호인은 위의 제1 문단에서 언급된 문제에 관련하여 어떤 구두 혹은 서면의 수임료 동의서 및 협약도 없다.
